The EU’s Data Act, which entered into force early this year, comes closer to taking effect. The Data Act will start to apply in the EU in nine months, on the 12th of September 2025, giving us less than a year to prepare. How will this affect your business?
What is the EU Data Act?
The Data Act lays out a set of new rules and regulations – mostly touching on the Internet of Things and the Cloud. According to the EU Commission, the Data Act will enable a fair distribution of the value of data by establishing “clear and fair rules for accessing and using data within the European data economy,” a necessity heightened by the growing prevalence of the Internet of Things (IoT).
Most relevant to us, however, is the set of rules setting the framework for customers to effectively switch between different providers of data-processing services. These will impact long-term data retention and handling far beyond the other sets of regulations the Data Act lays out.
How will this impact your business?
The major impacts are likely to stem from increased sharing of data; with the barriers to sharing being strikingly reduced, we can expect to see more work on the seamless transfer of valuable data between data holders and data users while upholding its confidentiality. This will, according to the EU, encourage more actors to participate in the data economy. Rules are also being added enabling public sector bodies to access and use data held by the private sector for specific public interest purposes.
For most organizations, this will require better data handling to enable data sharing on request; beyond the simple need for keeping copies of relevant data for backups or long-term retention in archives, the addition of data generated by IOT devices will require more robust data storage, discovery and sharing infrastructure.
